Terms of Service.
The agreement between you and MEKK Financials when you use this website, buy a digital toolkit, or engage us for services. Plain language wherever we can manage it.
These Terms of Service ("Terms") govern your access to and use of the MEKK Financials website (mekkfinancials.com), our digital toolkits, and our consulting and fractional CFO services (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
"MEKK Financials," "we," "us," and "our" refer to MEKK Financials. "You" refers to the owner or representative engaging with us.
1. Who we are and what we do
MEKK Financials helps construction and service business owners build financial, operational, and leadership systems. We offer two kinds of Services:
- Digital toolkits — downloadable templates, SOPs, checklists, and guides sold through our store and delivered as PDF and fillable DOCX.
- Consulting and fractional CFO services — engagements scoped and priced individually under a separate service agreement.
2. Using this website
You may use this site for lawful, personal, and business purposes. You agree not to misuse it — including not to disrupt the site, attempt unauthorized access, scrape content for resale, or use it to transmit anything unlawful or harassing.
We may change, suspend, or discontinue any part of the website at any time without notice.
3. Accounts and purchases
When you buy a toolkit or engage our services, you provide accurate, current, and complete information. You are responsible for keeping your account and payment credentials secure.
4. Digital toolkits — license, not a sale
When you purchase a toolkit, you receive a single-business license to use that toolkit internally within one business. The toolkit is licensed, not sold. Specifically, you may:
- Download, fill in, edit, and use the toolkit inside your own business.
- Make reasonable internal copies for your team's use.
You may not:
- Resell, sublicense, redistribute, or share the toolkit outside your business.
- Repackage or rebrand the toolkit for sale or distribution.
- Remove or alter any copyright, trademark, or attribution notices.
If you want to use a toolkit across multiple businesses you own or control, contact us for a multi-business license.
For purchases made through our store, Lemon Squeezy LLC acts as the merchant of record. Lemon Squeezy processes your payment, handles applicable sales tax and VAT, and is the seller of record for the transaction. "Lemon Squeezy" or "LEMONSQUEEZY" may appear on your bank or card statement.
MEKK Financials is the creator and provider of the digital goods. Lemon Squeezy's terms and privacy policy also apply to store purchases. See the Lemon Squeezy Terms and Privacy Policy.
5. Payment and billing
Prices are listed in US dollars. Store purchases are processed by Lemon Squeezy (and its payment partners) at checkout. Consulting services are billed under the terms of your individual service agreement. We may change pricing at any time; changes do not affect purchases already made.
6. Refunds
Our refund practices are described in our Refund Policy. Because toolkits are digital goods delivered instantly, refunds are handled differently than for physical products.
7. No legal, tax, or financial advice
Our toolkits and content are practical business documents and educational material, not legal, tax, accounting, or financial advice. They are not a substitute for licensed professionals. Employment law, tax, and regulatory requirements vary by state and circumstance — before acting on anything in a toolkit, have your state-specific counsel or a qualified HR, tax, or financial professional review it.
Consulting services are advisory in nature. You remain responsible for the decisions you make in your business.
8. Intellectual property
All content on this site and in our toolkits — including text, graphics, logos, templates, and methodology — is owned by MEKK Financials or its licensors and is protected by intellectual property laws. Nothing on this site grants you any right to use our trademarks, logos, or brand without written permission.
9. Third-party links and services
Our toolkits and site may link to third-party resources (videos, courses, tools) we believe are useful. We don't control and aren't responsible for their content, availability, or practices. Our site and store also rely on third parties (such as Lemon Squeezy, Stripe, and our hosting and analytics providers) whose terms and privacy policies apply to your use of their services.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, MEKK Financials disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Services will be uninterrupted, error-free, or that any toolkit will produce a specific business result.
11. Limitation of liability
To the fullest extent permitted by law, MEKK Financials and its owners, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services — even if advised of the possibility. Our total liability for any claim related to the Services is limited to the amount you paid us for the toolkit or service giving rise to the claim, or one hundred US dollars ($100), whichever is greater.
12. Indemnification
You agree to indemnify and hold MEKK Financials harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your infringement of anyone's rights.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. We'll try in good faith to resolve any dispute informally first. If we can't, disputes will be resolved in the state or federal courts located in Delaware.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Services after changes means you accept the updated Terms.
